Mediation Overview

Process: Mediation involves setting a date for the parties to discuss and resolve their dispute. A qualified mediator helps the parties reach an agreement. Parties may be in the same room or spend significant time in private sessions with the mediator.

Mediator's Role: The mediator is not a judge and cannot provide legal advice. Remaining neutral, the mediator makes no judgments about who is ‘right’ or ‘wrong.’ They listen to the issues keeping the dispute alive and facilitate a satisfactory settlement.

Settlement Possibility: Once parties agree to mediate, reaching a settlement is a realistic prospect. Many mediations conclude within one working day.

Key Features

Confidentiality: If no settlement is reached, information disclosed during mediation cannot be used in court. Private discussions with the mediator are not shared with the other party without consent.

Voluntariness: Mediation is voluntary in civil, commercial, and workplace disputes. Family mediation is also voluntary but requires a MIAM (Mediation Information Assessment Meeting) before starting private law proceedings. Parties can end the mediation process if it is no longer beneficial.

Independence: Neutral mediators or co-mediators facilitate discussions without a stake in the outcome. They do not suggest solutions or provide legal advice but will test the feasibility of the parties’ positions and desired outcomes.

Mediation Locations

Remote Mediation: Conducted via Zoom, remote mediation allows parties to resolve disputes with available technology. Mediators can demonstrate the technology and use breakout rooms for private discussions.

In-Person Mediation at Garden Court Chambers: Held at our offices in Lincoln’s Inn Fields, Holborn, this option includes the use of three rooms and refreshments throughout the day. Lunch can be provided with 48 hours' notice.

In-Person Mediation at Other Venues: Mediation can also occur at external venues with room and refreshment costs split between parties. Travel costs may apply but are considered at the enquiry stage. Local mediations may not incur additional costs.

On-Site Mediation/Site Visits: When appropriate, a mediator can visit the dispute site to understand perspectives better. Mediation can then proceed remotely or in person if a suitable space is available on-site.
